BCBS Antitrust Settlement: Getting Closer To Payouts

The long-running BCBS Antitrust Settlement is finally moving closer to distributing payments. After years of waiting, the process has reached a major milestone: determination and deficiency letters have been issued.

Note: this is a separate case from the BCBS Providers Settlement.

What Just Happened?

Those who filed claims are now receiving determination letters. These letters confirm the administrator's records of your Total Premiums Paid and/or Total Administrative Fees Paid to Blue Cross Blue Shield during the class period.

This figure is not your payout amount - but it is the critical number that will be used to calculate your eventual recovery. Payment amounts will depend on:

  • The number of valid claims filed
  • How much you paid in premiums or fees to one or more of the settling defendants
  • Whether your coverage was fully insured or self-funded

At the same time, some filers have received deficiency letters, which gives them the chance to fix issues with their original claim submissions.

Why This Matters

For claimants, this stage is your opportunity to:

  • Review your determination letter carefully and confirm the values match your records
  • Challenge discrepancies if you believe your premiums or fees are understated
  • Perfect your claim if you received a deficiency notice

If you disagree with the administrator's figures, you'll need to provide supporting documentation - and you only have 30 days from the date of your determination letter to respond.
