Recently all the class action talk has been about the Illinois Biometric Information Privacy Act, or BIPA, which passed in 2008 to fight back against the misuse of personal data. This law has already helped people receive compensatory settlements in landmark cases like the $650M Facebook BIPA Settlement and $100M Google BIPA Settlement. Interestingly, Texas passed a similar law in 2001 based on the assumption that biometrics would eventually become the new password and needed to be protected, but such historic settlements are yet to come in that state.

Two decades later, Texas, Illinois, and Washington along with a few cities like Baltimore, Portland, and New York have passed laws that regulate the use of biometrics. Many other states are reviewing legislation and stronger data privacy laws enacted in California, Colorado, and Virginia will now treat biometrics as sensitive data and in some cases require special opt-outs, or consent to be given. CCC is on top of these BIPA trends and is excited to continue helping people participate in these settlements.

We are currently tracking BIPA cases involving companies such as McDonald’s, Walmart, Snapchat, Instagram, and others, so stay informed with CCC’s blogs and reach out if you believe you qualify in one of these settlements. Please also feel free to check out two open settlements in the Google BIPA Settlement http://googlebipasettlement.com/  and the Facebook Internet Tracking Settlement https://fbinternettrackingsettlement.com/

    • Please avoid using explicit language, but note these are separate cases. We are happy to help you participate in the Google BIPA settlement, however the Facebook BIPA settlement is closed.
