US Senate Rolls Out Data Privacy Bill: How this May Affect Your Settlement Eligibility

The Illinois Biometric Information Privacy Act, or BIPA, was passed to fight back against misuse of personal data. This law has helped people receive compensatory settlements when their data has been compromised or used wrongfully. 

The passing of privacy legislation such as BIPA on the state level is pressuring federal legislators to focus on protecting Americans’ online information on a more national scale. On May 20, Sen. Amy Klobuchar submitted a bipartisan bill that would force websites to grant users greater control over their data and allow them to opt out of data tracking and collection.

“For too long companies have profited off of Americans’ online data while consumers have been left in the dark. This legislation will protect and empower consumers by allowing them to make choices about how companies use their data and inform them of how they can protect personal information.”

A nationwide privacy act not only helps Americans protect their personal data, but it could mean larger class action settlements. In the Tik Tok settlement agreed upon in March, Illinois subclass members will receive almost six times the amount as other class members nationwide, thanks in large part to BIPA. More focus on tech companies’ handling of customer data may also lead to more settlement cases.
